A Wainscott landfall site does not represent the ‘minimum adverse environmental impact’ as required by Public Service Law §126-1. Moreover, the Applicant has not complied with the PSC’s regulations or the Public Service Law in performing an adequate alternatives analysis. For those reasons, the Commission should adopt the new alternatives that have been identified or send the Applicant back to the drawing board.
